Terms and Conditions of Use

1. About Limit Breakers and Our Services

Limit Breakers Tutoring Ltd ("Limit Breakers", "we", "us", or "our") is an educational services company registered in England and Wales. We provide a range of Services designed to support children in their academic development, including preparation for the 11+ examination and other assessments.

The specific Services available to you depend on your enrolment. Details are provided at the point of registration. Limit Breakers does not guarantee admission to any school or any specific academic result; outcomes depend on the Student's individual effort, ability, and circumstances.

2. Who These Terms Apply To

These Terms apply to all users of the Limit Breakers website, platform, and Services, including the AcademicTrack parent dashboard.

Limit Breakers' Services are designed for children aged 7 to 16 years old (school Years 3 to 11 in England and Wales). The AcademicTrack platform is intended to be used by parents and guardians — not directly by children. All accounts must be created and managed by a parent or legal guardian ("Responsible Adult") on behalf of their child ("Student").

By registering an account or using our Services, the Responsible Adult confirms that they:

3. Account Registration and Security

To access the AcademicTrack platform and certain other Services, you must register an account. You agree to:

Limit Breakers reserves the right to suspend or terminate accounts where there is evidence of account sharing, misuse, or breach of these Terms.

4. Payment and Access

Both free and paid Services are offered. Paid Services are available via subscription or one-time purchase, as described at the point of registration.

Bootcamp and workshop sessions require separate registration and payment — see Section 7. 

5. Children's Data, Privacy, and the ICO Children's Code

5.1  Our Commitment to Children's Data

Limit Breakers designs its services in line with the ICO Age Appropriate Design Code (the "Children's Code"), which sets the standard for services likely to be accessed by children. We apply higher privacy protections to the personal data of Students and do not use it for purposes incompatible with the delivery of our Services.

5.2  Personal Data We Process

In connection with the Student's participation in the Services, Limit Breakers processes the following categories of personal data relating to the Student:

The Responsible Adult's name, email address, and account credentials are also collected for account management, communication, and payment purposes.

5.3  Lawful Bases for Processing

We process personal data under the following lawful bases:

Where we rely on legitimate interests in relation to a Student's personal data, we carry out a documented balancing test that gives appropriate weight to the interests, rights, and freedoms of the child. We will not rely on legitimate interests as a lawful basis where the child's interests override ours.

5.4  Use of Artificial Intelligence

Limit Breakers uses an artificial intelligence service provided by Anthropic, PBC ("Anthropic") to generate personalised tutor notes and weekly focus recommendations for Students. These notes are a commentary on the Student's progress and areas for improvement — they are not study materials. All course content, quizzes, curriculum materials, and session content are created by Limit Breakers and its tutors.

In order to generate tutor notes, a limited set of Student data is transmitted to Anthropic, including the Student's first name, pronouns derived from the Student's gender, and performance data such as assessment scores, topic performance, and engagement data. Limit Breakers will update this section if the categories of data transmitted to Anthropic materially change.

By accepting these Terms, the Responsible Adult consents to this data being processed by Anthropic solely for the purpose of generating personalised tutor notes. Anthropic acts as a data processor on behalf of Limit Breakers and is subject to a data processing agreement. Limit Breakers does not use AI-generated content for any purpose other than delivering the Services to the Student.

AI-generated tutor notes are supplementary guidance only and do not replace the professional judgement of qualified tutors or educators. Limit Breakers does not guarantee their accuracy or completeness. Responsible Adults should raise any concerns about a Student's progress directly with a Limit Breakers tutor.

5.5  Data Retention

We retain personal data only for as long as necessary for the purposes set out in these Terms. Indicative retention periods are:

The Responsible Adult may request deletion of the Student's personal data at any time by contacting [email protected]. Requests will be actioned within 30 days, subject to our legal obligations to retain certain records.

5.6  Parental Rights and Responsibilities

By registering on behalf of a Student, the Responsible Adult confirms they have read and understood the Limit Breakers Privacy Policy at limitbreakers.co.uk/privacy-policy and accept its terms on behalf of the Student. The Responsible Adult agrees to:

6. Tutoring Sessions and Safeguarding

All tutors delivering live sessions on behalf of Limit Breakers hold an enhanced DBS (Disclosure and Barring Service) check, or the equivalent local check for tutors based outside England and Wales.

Users must behave respectfully during all live tutoring sessions, workshops, and bootcamps. Harassment, disruptive conduct, or inappropriate behaviour is prohibited and may result in immediate removal from a session, or suspension or termination of the account. Users must not contact tutors outside of official Limit Breakers channels.

Live sessions are not routinely recorded. In limited circumstances (for example, where a recording is necessary for audit, quality assurance, or safeguarding purposes), sessions may be recorded. Where a recording is made, it is stored securely on our learning management platform, accessible only to authorised Limit Breakers personnel, and deleted within 30 days unless we are required to retain it longer for safeguarding or legal reasons. Responsible Adults will be informed where a session has been recorded.

7. Bootcamp and Workshop Sessions

7.1  Registration and Payment Confirmation

Bootcamp and workshop sessions are available as optional supplements to the core Services. A place is only confirmed once payment has been completed in full through the relevant payment platform. Registration without completing payment does not constitute a confirmed booking and does not reserve a place. Limit Breakers reserves the right to release unconfirmed places to other students.

7.2  Cancellation or Rescheduling by Limit Breakers

Limit Breakers reserves the right to cancel or reschedule any session in circumstances beyond its reasonable control, including tutor illness, venue unavailability, technical failure, or insufficient enrolments. In such cases:

Limit Breakers is not liable for any costs incurred by the Responsible Adult as a result of a cancellation or rescheduling (such as travel or childcare costs) beyond the refund of the session fee.

8. Cancellation and Refunds

8.1  Cancellation Before Service Start

The Responsible Adult may cancel their enrolment in any Service at any time before that Service's start date and receive a full refund. To cancel, notify Limit Breakers in writing at [contact email address]. Refunds will be processed within 14 days to the original payment method.

8.2  Cancellation After Service Start

Following the start date of any ongoing Service (such as a term-length programme or tutoring subscription), the Responsible Adult may cancel by providing 30 days' written notice to Limit Breakers at [contact email address]. Access to the Service continues for the duration of the notice period. No refund is payable for any portion of the Service already delivered, except where Limit Breakers is in material breach of these Terms.

8.3  One-Off Sessions

One-off Services (including individual tutoring sessions, workshops, and single bootcamp sessions) are governed by the following cancellation terms:

8.4  Digital Content

For digital content (including downloadable practice papers, mark schemes, and pre-recorded materials), you expressly request immediate access and acknowledge that by streaming, accessing, or downloading the content you consent to immediate delivery and waive your statutory 14-day right to cancel under the Consumer Contracts Regulations 2013. Such purchases are therefore non-refundable once accessed or downloaded.

Nothing in this section affects your statutory rights under the Consumer Rights Act 2015 where digital content is faulty, not as described, or not of satisfactory quality.

 

9. Intellectual Property

All content created by Limit Breakers — including video lessons, quizzes, assessments, written explanations, and downloadable worksheets — is owned by Limit Breakers Tutoring Ltd or its licensors. You receive a personal, non-commercial licence to use it for your own study only, and may not copy, distribute, resell, or share it outside your household.

Some practice materials on the platform may include or be derived from third-party examination content, which remains the property of its respective rights-holders. Where this is the case, those rights-holders retain all rights in that content, and any access provided to you is for personal, non-commercial educational use only.

User-generated content (e.g. forum posts) remains yours, but you grant us a licence to display and operate it within the platform.

10. User Conduct

All users of the Limit Breakers platform and Services agree to:

Responsible Adults are responsible for ensuring that Students comply with these conduct standards and for supervising their use of the platform.

 

11. Cookies

We use cookies and similar technologies to enable essential site functions and to improve the user experience. By using our platform, you agree to our use of cookies in accordance with our Cookie Policy, available at limitbreakers.co.uk/cookie-policy.

12. Service Availability and Changes

Limit Breakers aims to keep the platform and all online Services available at all times but does not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible.

Limit Breakers reserves the right to modify, update, or withdraw elements of any Service from time to time. Any material changes to what is included in a paid enrolment will be communicated to Responsible Adults with reasonable notice.

Limit Breakers also reserves the right to update these Terms from time to time. Where changes are material, we will notify Responsible Adults by email. Continued use of the Services following notification constitutes acceptance of the updated Terms.

 

13. Reporting Infringement or Abuse

If you believe content on our platform infringes your rights or is otherwise unlawful, please email [email protected] with a description of the content and its location, the nature of the infringement or concern, and your contact details and confirmation of your authority to raise the complaint. We will investigate and take appropriate action.

14. Suspension and Termination

Limit Breakers may suspend or terminate access to the Services if a Responsible Adult or Student breaches these Terms, fails to make payment for paid Services, engages in misuse or illegal activity, or poses a safeguarding or safety concern. Responsible Adults may also delete their account voluntarily. Personal data following account closure will be handled in accordance with Section 5.5 of these Terms.

15. No Guarantee of Outcomes

Limit Breakers' Services are designed to support academic development and examination preparation. Limit Breakers does not guarantee any specific academic outcome, examination result, school place, or level of progress. Results depend on a range of factors beyond Limit Breakers' control, including the Student's individual ability, commitment, attendance, and the requirements of the relevant examination board or institution.

18. Institutional and School Access

Schools, tutoring companies, and other organisations wishing to access the Services must hold a licensed organisational account. The organisation is responsible for ensuring all its users comply with these Terms. For partnership and licensing enquiries, contact [email protected].

19. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales. Consumers located outside the UK retain any non-waivable consumer rights under their local law.
